1)Scope
All orders placed via our Online Shop are subject to the following General Terms and Conditions of Business (GTCB).
2) Contractual partner
Our Online Shop is intended exclusively for private individuals (“Consumers”) who make purchases for purposes that are predominantly outside their trade, business, or profession. Sales to business customers are excluded.
Eligibility: You may not order or receive products or services from this website if:
(a) you do not agree to these Terms and Conditions of Sale;
(b) you are not at least 18 years old or otherwise legally capable of entering a binding contract; or
(c) you are prohibited from accessing or using this website under applicable law.
3) Conclusion of contract
By placing an order (“Order”) with Magnat, you are making a binding offer to purchase the selected product(s). All orders are subject to acceptance by Magnat. Please note that Magnat reserves the right to reject any order—either in whole or in part—for any lawful reason, at its sole discretion.
Confirmation of receipt of your order is sent by email immediately after your order is sent. This email is sent automatically and does not represent a declaration of acceptance on our part.
A contract only forms once we acknowledge our express acceptance of your order (acceptance declaration, order confirmation or shipping confirmation) or the goods are dispatched. If we do not declare acceptance of the contract within 10 working days, no contract is concluded.
In the event of a pricing error, Magnat will inform you of the correct price. If you do not agree to the adjusted pricing, the order will be cancelled, and any payment already made will be fully refunded. This refund represents the maximum extent of Magnat’s liability in such cases.
4) Contract text storage
We store the text of the contract and send you the order data and our GTCB by email.
5) Delivery terms
We deliver free of shipping costs within Germany. We deliver by way of dispatch only. Collection by the customer is unfortunately not possible.
6) Prices
The price charged for a product is the valid price at the time of the order and will be listed in your confirmation email. Prices shown on our website may change without prior notice. Prices include standard shipping and handling costs using our selected carrier.
7) Payment
Available payment methods are shown during checkout. Credit card payments are processed by a third-party payment provider. The provider collects and stores your credit card information to process your payment. See our Privacy Policy for more information. All billed amounts must be paid in the currency listed on the invoice. By placing an order, you authorize us to transmit or obtain information about you from third parties for the purpose of processing the order, including verifying your credit or debit card or billing information to authenticate your identity.
The following payment methods are available to you in our shop.
a) PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To enable payment of the invoice amount via PayPal, you must already be registered or first register there, validate this with your access data and give us confirmation of the payment instruction. After the order has been placed in the shop, we request PayPal to initiate the payment transaction. The payment transaction will then immediately be processed by PayPal automatically. You will receive further information during the ordering process.
b) PayPal Plus
As part of the PayPal payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There you can specify your payment details, confirm the use of your data by PayPal and confirm the payment order to PayPal.
i)PayPal Plus: Credit card
If you have opted for the credit card payment method, you do not have to be registered with PayPal to be able to pay the invoice amount. Immediately after confirmation of the payment order and validation that you are the legitimate card holder, the payment transaction will be executed by your credit card company at PayPal’s request and charged to your card . You will receive further information during the ordering process.
ii) PayPal Plus: Lastschrift
If you have opted for the direct debit payment method, you do not have to be registered with PayPal to be able to pay the invoice amount. By confirming the payment order, you issue PayPal with a direct debit mandate. PayPal will inform you of the date of debit from the account (pre-notification). Upon submitting the direct debit mandate immediately after confirmation of the payment order, PayPal will request its bank to initiate the payment transaction. The payment transaction is then processed and charged to your account. You will receive further information during the ordering process
iii) PayPal Plus: Invoice
If you have opted for the invoice payment method, you do not have to be registered with PayPal to be able to pay the invoice amount. Following a successful address and credit check and placement of the order, we assign our claim to PayPal. In this case, you can only make payment to PayPal with a debt-discharging effect. Payment processing via PayPal is subject to PayPal’s GTCB and privacy policy – in addition to our GTCB.
c) Off-set exclusion
The offsetting of claims that you might be entitled to is excluded insofar as your claim to be offset is not uncontested or recognized by declaratory judgment.
8)Taxes
We are legally required to collect taxes based on the destination where your product is shipped or delivered. Taxes will be displayed during checkout and are included in the final charge to your credit card.
9)Discount Codes
When discount codes are offered or available, only one discount code may be used per order. We reserve the right to cancel or reject any order that uses more than one discount code. You may use discount codes only under the conditions under which they were issued, including eligibility criteria and maximum order value. Discount codes and other promotions are subject to these Terms and any additional conditions specific to the promotion.
For products ordered directly from the website, the company guarantees 100% satisfaction for 30 days from the date of purchase, or your money back. If you are not satisfied with our product, you may return it to the company within thirty (30) days of the order date and receive a replacement or a full refund of the purchase price. The company does not accept returns of products sold in retail stores, department stores, amazon or other stores that may sell the product. To obtain a refund, you must follow these steps:
10) Right of return
(a) The product must be in the same condition as when you received it and in its original packaging.
(b) Click here to request a refund. We will need the email address you used to place the order and the order number found in your order confirmation email.
(c) Clearly place the return label you receive on the outside of the returned package. Our returns department is not authorized to process packages without the return label provided to you by us after you have completed the above steps; and no refunds will be issued for packages sent without a return label, including packages marked “return to sender.”
(d) All returned products must be shipped in their original packaging with the return label provided by Magnat after your return request has been approved. If you use this return label, Magnat will cover the shipping costs.
(e) Returned products must be received within fifteen (15) days of receiving your RMA number.
(f) Refunds will only be made to the same payment method used to order the product. Refunds typically take 14 business days to process. Refunds include the cost of the product. Shipping and handling costs are non-refundable.
Fair use of our return policy. If a return is necessary, please read our return policy and we will be happy to assist you. To combat potential fraud and unfair practices, we monitor for potential abuse of our return policy. Fraudulent or excessive return activity may result in rejection of future return requests.
11) Reservation of title
The goods remain our property until full payment has been made.
12) Shipping and Delivery Dates Are Estimates
Delivery dates are estimates only. We are not liable for delays beyond our reasonable control. If we cannot ship within the expected timeframe or within thirty (30) days of a properly placed order, we may request your approval for a delayed shipment. Without approval, we will cancel your order and refund any payments made.
It is your responsibility to provide a complete and accurate shipping address. We are not liable for issues arising from incorrect or incomplete information.
13) Transport damage
If goods are delivered with obvious transport damage, please lodge a complaint about such defects with the delivery agent as soon as possible and contact us without delay. Failure to file a complaint or make contact does not have any consequences at all for your statutory entitlements and their enforcement, in particular your warranty rights. By doing so, however, you help us to be able to assert our own claims against the carrier or transport insurer.
Sometimes product demand exceeds supply. If this happens, we ask you to provide your email address so we can notify you when the product is back in stock.
14) Out of stock products
Sometimes demand for products is so high that it exceeds supply. In this case, we ask you to provide us with your email address so that we can notify you when new products become available.
15) Cancellations
We aim for excellent customer service, so most orders are promptly processed. All sales on our website are final. If you recently placed an order and want to cancel it, please contact our customer service at the following [link]. If the order has not been processed, we will make reasonable efforts to accommodate your request. If cancellation is not possible, you may still return the product under our return and refund policy.
16) Warranty and guarantees
The Company warrants that its products will be free from material and workmanship defects during the product’s limited warranty period (see warranty statement included with the product). Warranty applies only to the original purchaser and begins on the purchase date.
a) For consumers, the limitation period for claims for defects when purchasing new goods is 2 years from the date on which the item was delivered to the customer. For used goods, the limitation period for claims for defects is one year from the date on which the item was delivered to the customer
b) In addition to the statutory warranty rights, you may have entitlements arising from independent guarantees if a corresponding agreement has been made. Information concerning any applicable additional guarantees and their exact conditions can be found in the product description. The guarantee conditions are also enclosed with the delivered item.
17) Liability
a) For claims due to damage caused by us, our legal representatives or vicarious agents, we assume unlimited liability in each case in the event of injury to life, body or health, willful or grossly negligent breach of duty, guarantee commitments, where agreed, or insofar as is covered by the scope of the product liability law
b) In the event of a breach of essential contractual obligations, the fulfillment of which enables the due and proper execution of the contract at all and compliance with which may regularly be relied on by the contractual partner, (cardinal obligations) caused by ordinary negligence on our part or on the part of our legal representatives or vicarious agents, liability shall be limited in terms of the amount to the loss or damage, the occurrence of which should typically be expected and was foreseeable at the time of concluding the contract.
c) Any claims for damages or compensation are otherwise excluded
18) Concluding provisions
a) Contracts between you and us are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws in your country of residence remain unaffected.
b) We process your personal data in accordance with our Privacy Policy, available [here] (insert link).
c) Should any provision of these GTCB be or become invalid, this shall not affect the validity of the remaining provisions. The parties shall replace the invalid provision with one that most closely reflects the original intent in economic terms.
d) The contractual language is German.
